Terms of service

These Terms of Service ("Terms") apply when you visit or buy from JP MODE ("we", "us", "our"), including our website and all related services (the "Services"). By using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

1. Your Account

You must be at least the age of majority where you live to place an order. Anyone younger may use the Services only with a parent or guardian involved. The information you give us must be correct, current and complete. You are responsible for keeping your login safe and for everything done on your account, and you may not transfer your account to anyone else.

2. Our Products

We sell alcohol based fragrances for external use on skin. Every listing states the size, the concentration and the fragrance family exactly as our supplier confirms them to us; if a detail is not confirmed, we leave it off the page rather than guess. Screens vary, so a bottle or a liquid may look slightly different in colour from the photograph. Fragrance also behaves differently on different skin and in different weather, so we do not promise how long a scent will last on you. We may change a description, stop selling a product or limit quantities at any time.

3. Orders

When you place an order you are making an offer to buy. Your order is accepted only when we confirm it, and we must receive your payment first. We may decline or cancel an order, for example if a product is unavailable or there is an error in the price or the description. If we cancel an order you have already paid for, we refund you in full and tell you using the contact details you gave at checkout. Purchases are for your own personal use, not for resale.

4. Prices and Payment

All prices are in US dollars (USD) and can change without notice. You pay the price shown when you place your order, as set out in your order confirmation email. Shipping and any sales tax are added at checkout and shown before you pay. Promotions may carry their own terms, and those terms apply if they conflict with these Terms.

You confirm that the payment details you give us are correct and that you are allowed to use the payment method. For more, see our Payment Policy.

5. Shipping and Delivery

Delivery times are estimates, not guarantees. Perfume is classed by carriers as a limited quantity flammable liquid, so your order travels by ground transport and cannot be sent by air. We are not responsible for delays caused by carriers or by events outside our control. If your parcel is delayed, lost or arrives damaged, please see our Shipping Policy and contact us so we can help.

6. Intellectual Property

The content on the Services, including the text, photographs, graphics, logo and design, is owned by JP MODE or by its respective owners and is protected by law. The JP MODE name and logo are our trademarks, the Shopify name and logo are trademarks of Shopify, and every other name and logo belongs to its owner.

You may use the Services for your own personal, non commercial use only. You may not copy, reproduce, republish or distribute any part of them without our written permission.

7. Third-Party Tools and Links

The Services include tools and links provided by other companies, such as the carrier tracking page. We do not control them, we provide them "as is", and you use them at your own risk and under their own terms.

8. Relationship with Shopify

JP MODE is powered by Shopify, which enables us to provide the Services to you. Any sale or purchase you make in our store is made directly with JP MODE. By using the Services you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and JP MODE, including any injury, damage or loss resulting from the products or services you buy. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with JP MODE.

9. Privacy

Personal information you give us is handled under our Privacy Policy. Because our store is hosted by Shopify, some of it is also processed by Shopify under the Shopify Consumer Privacy Policy.

10. Reviews and Feedback

If you send us a review, an idea or any other feedback, you allow us to use, publish and share it for any purpose, including commercially, without paying you. Your feedback must be your own, lawful and not misleading, and you must tell us if you received anything in return for it. We may remove any content we consider unlawful, offensive or misleading.

11. Errors

The website may sometimes contain an error in a description, a price, a shipping cost, a delivery time or availability. We may correct errors, update information and cancel an order affected by an error at any time, even after you have placed it.

12. Acceptable Use

You may use the Services for lawful purposes only. You must not:

break any law, or infringe our rights or anyone else's;
harass, abuse or harm anyone, or give false or misleading information;
send spam, pretend to be someone else, or collect other people's personal information;
upload viruses or malicious code, or try to get around our security;
copy, resell or scrape any part of the Services with bots, scrapers or other automated tools without our permission.

Any software agent, including an AI agent, that uses the Services must clearly identify itself as an agent in its requests, answer truthfully if asked whether it is automated, and must not get around measures that limit automated access, such as CAPTCHAs. We may suspend or close your account if you break these Terms.

13. Termination

We may end these Terms or your access to the Services at any time without notice. You remain responsible for any amount you owe. Sections that by their nature should continue, such as intellectual property, disclaimers, limitation of liability, indemnification and governing law, continue to apply.

14. Disclaimer of Warranties

Except where we state otherwise in writing, the Services and all products are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non infringement. We do not promise that the Services will be uninterrupted, secure or error free. Some places do not allow these exclusions, so they may not apply to you.

15. Limitation of Liability

To the fullest extent permitted by law, JP MODE, Shopify and their affiliates, partners, employees, service providers and licensors are not liable for any injury, loss or claim, or for any direct, indirect, incidental, special, punitive or consequential damages, including lost profits, revenue, savings or data, arising from your use of the Services or of any product bought through them, even if we were told they were possible.

16. Indemnification

You agree to indemnify and hold harmless JP MODE, Shopify and our affiliates, partners, employees, agents and service providers from any claim, loss or cost, including reasonable legal fees, arising from your breach of these Terms, your breach of any law or anyone's rights, or your use of the Services.

17. General

Severability: if any part of these Terms is found unenforceable, the rest still applies.
Waiver: if we do not enforce a right, we have not given it up.
Entire agreement: these Terms and the policies published on our website are the whole agreement between you and us, and replace any earlier version.
Assignment: you may not transfer your rights under these Terms without our written consent. We may transfer ours.
Headings: headings are there for convenience and do not change the meaning of these Terms.

18. Governing Law

These Terms are governed by the laws of the State of California, United States, where JP MODE is based. You and JP MODE agree to the jurisdiction of the state and federal courts located in California.

19. Changes to These Terms

We may update these Terms from time to time by posting the new version on this page. We give notice of material changes as the law requires. If you keep using the Services after a change is posted, you accept the updated Terms.
